Form I-9 compliance is more than just getting signatures! Regardless of E-Verify enrollment, holding a Government Sponsored Security Clearance, or type of business. EVERYONE working in the U.S. must complete a Form I-9.

Mandated by the Immigration Reform and Control Act of 1986, the Form I-9 is a United States Citizenship Immigration and Services Form. The Form I-9 is used by all US Employers to verify the identity and legal authorization to work for all paid employees in the United States. Independent Contractors are excluded from completing the Form I-9. Overseas employees working for a U.S. employer are not required to complete a Form I-9. 

The Form I-9 is a free form. The Form is available to the public via the United States Citizens and Immigration Services website here.

By the first day of pay-rolled employment (also known as the date of hire), the employee completes the Form. The employee is required to attest, that the information provided is both true and accurate. The employee will further need to provide physical documentation of employment eligibility for review and verification. 


As of August 1, 2023, employers must review Form I-9 documents from all new employees, in their physical presence, within three (3) days of the date of hire, and complete the Form, regardless of whether the employees physically report to a work location.

By August 30, 2023, employers not previously or presently enrolled in E-Verify, and in good standing, must conduct an in person (physical examination) of acceptable documentation.
